GENERAL TERMS AND CONDITIONS
The Happy Schools Reward Program is a loyalty reward program which is operated by Happy Schools Corp., a non-profit organization. In accepting to join or continue your Happy Schools Reward Program membership, you acknowledge that the Happy Schools Reward Program assumes no contractual or legal responsibility to you and has specifically limited its legal obligations in its arrangements with the partners who participate in the program. Happy Schools specifically reserves the right to amend, alter, withdraw or terminate the Happy Schools Reward Program (in whole or in part), any program, benefit or award or these rules either with or without notice.
In particular, you acknowledge as a condition of continued membership:
- The Happy Schools Reward Program has no monetary value whatsoever and cannot under any circumstances form the basis of a monetary claim against Happy Schools Corp.
- The Happy Schools Reward Program membership is limited to natural persons and no corporation, trust, partnership or other entity may hold membership in the Happy Schools Reward Program
- The Happy Schools Reward Program membership is personal and entirely contingent upon active registration in and good standing with the Happy Schools and its teacher registration program. Membership cannot be assigned, traded, willed or otherwise transferred (other than with the consent of Happy Schools Inc. and in accordance with the Terms and Conditions of the Happy Schools Reward Program) and any assignment or transfer in violation of these rules will be void and may, at the discretion of Happy Schools Inc., result in the loss of membership
- Happy Schools Corp. assumes no liability to members whatsoever, including without limitation, liability by reason of the termination of or amendment to the Happy Schools Reward Program in whole or in part, the addition or deletion of reward partners with or without notice
- Happy Schools Reward Program membership is a privilege which can be revoked by Happy Schools Inc. at its discretion at any time and without compensation including without limitation, abuse by the member of any of the Terms and Conditions of the program or any other actions deemed by Happy Schools Inc, acting in its sole discretion, to be deleterious to Happy Schools Inc, the Happy Schools Reward Program or the interests of its partners
- Happy Schools Corp. shall be under no obligation to continue the program or to provide any notice of its termination
- The Happy Schools Reward Program and all companies affiliated with the Happy Schools Reward Program will not be responsible for correspondence lost or delayed in the mail or otherwise
- A Happy Schools Reward Program member is automatic with a Happy Schools registration. It is understood that every person is enrolling individually, only once, and in his/her full legal name. Membership is solely for the benefit of the individual, therefore it will be maintained in the name of an individual
- Each member is responsible for keeping up to date on the Happy Schools Reward Program regulations and the Happy Schools Reward Program shall have no liability for any failure to do so
- Each member shall be responsible for advising the Happy Schools Reward Program of any change of address. The Happy Schools Reward Program shall not be liable for misdirected mail, or any consequences thereof
- The Happy Schools Reward Program reserves the right to cancel the Happy Schools Reward Program membership of any Happy Schools Reward Program member at any time, at the discretion of the Happy Schools Reward Program with or without notice
- Your account information may only be given to you or a person designated by you in writing as defined earlier or pursuant to a court order or request from a government agency holding legislative power to compel such disclosure
- Proper legal documentation will be required from all members requesting a name change
- The Happy Schools Reward Program membership terminates upon death or personal bankruptcy of the member
- The Happy Schools Reward Program will be the final authority as to the interpretation of these Terms and Conditions
Governing Law
The Happy Schools Reward Program shall be governed by the laws of Alberta and the laws of Canada applicable therein. Any disputes regarding Happy Schools Reward Program or in any way arising out of the Happy Schools Reward Program membership, shall be submitted to the courts of Alberta whose courts shall have exclusive jurisdiction to hear such disputes.
